Information on the processing of personal data pursuant to art. 13 of Legislative Decree 196/03 “Code regarding the protection of personal data” and articles 13 and 14 of EU Regulation 679/2016 (“Regulations”).
Legislative Decree no. 196/2003 (hereinafter, for the sake of brevity, “Privacy Code”) and EU Regulation 679/2016 (hereafter, for the sake of brevity, “GDPR”) have the purpose of ensuring that the processing of personal data is carried out in compliance with the and fundamental freedoms, as well as the dignity of the person concerned, with particular reference to privacy and personal identity and the right to data protection.
Pursuant to art. 13 of the Privacy Code and articles 13 and ss. of the GDPR, in relation to the personal data that you provide or that you have provided us by sending your application or during the interview with the staff of our company, Airgest Spa, CF and P. IVA 01613650819, with registered office in Trapani, Frazione C / DA Birgi, V. Florio SNC Civil Airport, 91100, in the person of the Chairman of the Board of Directors (hereinafter referred to as “Airgest” or “Data Controller”) provides you with the following information.
Source and type of personal data.
The personal data voluntarily provided by you, both the common and possibly sensitive ones, will be processed by the Owner in accordance with the principles of correctness, lawfulness and transparency, and in compliance with your privacy and your rights. It will take place through appropriate tools to ensure the security and confidentiality of personal data required by law, in compliance with which the processing can be carried out, as well as manually by archiving on paper, including electronic tools to store, manage and transmit personal data.
The personal data being processed include:
– your identification data (such as, for example, name, surname, age, sex, place and date of birth, nationality, city of residence, address and e-mail, telephone number, etc.);
– data related to your training and career (such as, but not limited to, current and previous employment, information on recruitment or vocational training, curriculum vitae or work, the type of contract, the national collective labor contract) reference and role held in current employment, references provided by third parties in your favor, professional skills, etc.);
– data relating to your health (such as, for example, information relating to your health or any disability, if relevant for your ability or willingness to work or for the need for a tailor-made work station, for example in case of belonging to certain protected categories).
Purposes of data processing.
The processing of data will be made by the owner for the following purposes:
a) research and selection of personnel following your request;
b) evaluate your candidacy for the purposes of your possible recruitment for a role for which you have requested or for roles that could become available in the future, in compliance with the provisions of art. 24 of the Privacy Code and art. 6.1, lett.b) of the Regulations.
Method of treatment.
Your personal data will be processed:
– using IT and manual tools;
– by persons duly appointed to perform these tasks, constantly identified and / or appointed, appropriately instructed and made aware of the constraints imposed by law;
– with the use of security measures to guarantee the protection of your privacy and to avoid the risks of loss or destruction, unauthorized access, of treatments not permitted or not in accordance with the purposes of the processing;
– in compliance with the limits established by Law n. 300/1970 (the so-called “Statute of Workers”).
The data will be processed by the Data Controller for the time necessary for your assessment for the purposes of the possible unsaturation of the employment relationship. If you receive and accept a job offer from Airgest, the personal data collected in the period prior to your appointment will become part of the personal archive that concerns you and will be kept for the whole duration of your employment for which, in any case, the specific information will be provided. If Airgest does not proceed with your assumption, the data will be immediately deleted.
Nature of the provision of data.
The provision by you of the data necessary for the pursuit of the purposes referred to in paragraphs a) and b) is mandatory and is functional to the aforementioned purposes. Your refusal would imply the objective impossibility for Airgest to proceed with the verification of the conditions for the recruitment and / or start of the collaboration and, therefore, the possible establishment of the relationship with Airgest.
In addition, the data will be processed to comply with administrative and other rules required by law in force in our country or by virtue of EU decisions.
Categories of data recipients.
For the performance of some of the activities related to the processing of your personal data, Airgest may communicate your data to third parties, who will act as data controllers or independent data controllers:
a) companies, bodies, consortia, professionals who, on behalf of the Data Controller, provide specific processing services or perform related activities, instrumental or support to those of the Controller, or activities necessary for the execution of the employment relationship and operations or of the services you have requested or will request in the future, such as, for example, banking institutions, insurance companies, work consultants responsible for payroll processing, business medical consultants charged with assessing your suitability for the tasks assigned, other health bodies, collaborators self-employed members of the company, self-employed professionals, legal, tax and notary advisors;
b) social security and welfare institutions;
c) other offices of Airgest;
d) other subjects to whom the right to access your personal data is recognized by provisions of law or secondary or community legislation (such as public authorities).
Subjects who may be aware of personal data.
Consistent with the aforementioned purposes, personal data may be made aware of Airgest personnel duly appointed for the processing, such as by way of example the personnel belonging to the offices dealing with administrative and IT management and the personnel assigned to activities involving the processing of your data for one of the purposes set out in this statement.
Exercise of rights
Pursuant to articles 15-22, GDPR, by writing to the owner at the aforementioned postal address or e-mail, privacy@airgest.it you can exercise the rights of consultation, modification, cancellation and oblivion, limitation of data processing or oppose their processing for legitimate reasons.
It is also known that the interested party has the right to:
(i) submit a complaint to the supervisory authority to enforce your rights.
